Orange County Renter Rights & Santa Ana Rent Control Guide 2026

Verified for 2026 | Santa Ana Rent Stabilization & OC Vector Control

Orange County is a legal puzzle for renters. If you live in Santa Ana, you have some of the strongest rent control in California. If you live 10 minutes away in Irvine, you have none.

Furthermore, Orange County faces a unique pest threat: Red Imported Fire Ants. Because these ants can be deadly to pets and children, reporting them involves a special independent district, not your landlord.

1. Santa Ana: The 3% Rent Cap

In 2021, Santa Ana passed the Rent Stabilization and Just Cause Eviction Ordinance. It is much stronger than state law.

Know Your Rights (2026):

  • Cap: Rent increases are capped at 3% or 80% of CPI (whichever is lower).
  • Registry: Landlords MUST register their rental units with the city. If they aren’t registered, they cannot raise your rent legally.
  • Just Cause: Protection begins after just 30 days of occupancy (unlike 12 months for the rest of California).

Facing Retaliation or an Illegal Rent Hike?

If your landlord raises your rent over 3% to “cover the exterminator,” or if you need an emergency repair grant to use the “Repair and Deduct” remedy (Civil Code § 1942), there are local programs designed to protect Orange County tenants.

2. Anaheim: Mandatory Inspections

Anaheim uses a “Proactive” approach called the Quality Rental Housing Program. The city inspects rental properties periodically to ensure they meet health standards.

If you have roaches or bed bugs in Anaheim, you can report it to Code Enforcement (714-765-5158). Because the property is part of the Quality Housing Program, the landlord cannot claim they “didn’t know” about the maintenance standards.

3. Red Fire Ants: A Unique OC Danger

Orange County is ground zero for Red Imported Fire Ants (RIFA). These are not normal ants—they swarm and sting aggressively, which can be fatal for small pets.

Do Not Spray Them: Spraying Fire Ants with Raid usually makes them move the nest and split into two colonies. You must call the OC Vector Control District. They provide specialized baiting often at no cost to residents.

4. Costa Mesa & Other Cities

  • Costa Mesa: Recently passed a “Just Cause” ordinance with strict relocation fees. If you are evicted for “Substantial Remodel,” the landlord may owe you significant money.
  • Irvine / Huntington Beach: These cities rely on the state law (AB 1482). Rent is capped at 5% + CPI, and Just Cause applies after 12 months.

Frequently Asked Questions

Can my landlord evict me in Santa Ana for reporting bugs?

Absolutely not. Santa Ana has an Anti-Harassment Ordinance. Threatening eviction for requesting repairs is a crime under city law. You can file a complaint with the Rent Stabilization Division.

Does OC Vector Control charge for rat inspections?

No. Services are paid for by your property taxes. They will inspect for rats, mosquitoes, and fire ants for free. However, they usually do not treat inside the house (that’s your landlord’s job).

Who do I report bed bugs to in Anaheim?

Report bed bugs to Anaheim Code Enforcement (714-765-5158). Anaheim requires landlords to maintain properties under the Quality Housing Program, and bed bugs are a violation of health codes.

Taking Action into Your Own Hands?

If the city ordered your landlord to fix the problem, or if you are repairing and deducting, ensure you hire a reputable, SPCB-licensed company to guarantee the job is done right and you have the proper legal invoices.
